漢斯·凱爾森（Hans Kelsen，1881年10月11日—1973年4月19日）是20世紀著名奧地利裔美國人及猶太人法學家，法律實證主義的代表人物。

生平[編輯]

凱爾森生於布拉格，兩歲隨父母來到維也納，在維也納大學學習法律，1906年獲得博士學位。1911年，發表第一部代表作品《國家法學說的主要問題》（Hauptprobleme der Staatsrechtslehre）。1919年，凱爾森成為維也納大學國家法和行政法教授。1930年，成為德國科隆大學教授，1933年納粹掌權後，凱爾森被開除，前往瑞士的日內瓦高級國際關係及發展學院任教，1940年來到美國，後任教於加州大學柏克萊分校。
