白人初選
白人初選（英語：White primaries），是美國南方各州禁止白人以外的選民參加的初選。在約1890年到約1944年為止，很多南方州份都有白人初選。美國最高法院最初認為白人初選是合憲的[1]，但在9年後卻改判白人初選違反了憲法[2]。
白人初選的建立及意義[編輯]
白人初選首次是被民主黨人在19世紀後期使用。由於南方實際上是一黨制，而民主黨為優勢政黨，被初選排除事實上就已被決策程序所排除。白人初選在許多州被立法成「選擇性的包容」制度，指出只有白人能在初選中投票，或合法地將普選看成是唯一的州立選舉，和給予黨派決策程序的控制權[3]。
合法性的質疑[編輯]
在1920年代，美國公民自由聯盟（American Civil Liberties Union，簡稱ACLU）已開始質疑白人初選，但並未得到太多的吸引力，直到1923年一項德州的法律的通過。該德州法律明確地禁止非裔美國人參與民主黨初選。這是對憲法的具體違反，故ACLU選擇它作為主要案例[4]。
ACLU對該德州法律的挑戰，最終以史密斯訴奧爾賴特案之名受到最高法院的審理。最高法院在1944年判決，白人初選違憲[5]。
在「史密斯訴奧爾賴特案」之後[編輯]
ACLU在「史密斯訴奧爾賴特案」獲得的成功，只特別適用於該德州法律。然而，大部分的州都終止了它們選擇性地包容的白人初選。因為白人初選的終止，成千上萬的非裔美國人得以登記投票。然而，許多州仍然使用許多歧視性的作法，包括人頭稅和讀寫測驗以阻止非裔美國人投票。
