請特別注意：非美國來源的外國作品，必需在來源國與美國皆為自由授權，才能被維基共享資源接受。從中國首次發表的作品，除了某些情況下（如該發表作品不符合美國的著作權型態）在美國屬於公有領域，如果該作品在來源地的《烏拉圭回合協議法案》生效日期當時受著作權保護，則美國可以依據該法案進行回溯，恢復在美國的著作權保護（其中中華人民共和國的生效日期為1996年1月1日，中華民國則為2002年1月1日[1]）。
