BitLicense是紐約州金融服務部（NYSDFS）根據為公司設計的法規頒發的用於虛擬貨幣活動的營業執照的一類通用術語。[1][2][3][4] 這些規定僅限於涉及紐約或紐約居民的活動。[5]

這些法規將虛擬貨幣業務活動定義為以下任何一種類型的活動：

  • 接收用於交易或交易虛擬貨幣的虛擬貨幣，除非交易是為了非財務目的而進行的，並且不涉及超過一個名義虛擬貨幣的數量;
  • 代表他人存儲、持有、維護或控制虛擬貨幣;
  • 作為客戶業務買賣虛擬貨幣;
  • 作為客戶業務執行兌現或控制，管理或發行虛擬貨幣。

但是，以下兩項活動不在虛擬貨幣業務活動的定義範圍之內：

  • 自行開發和傳播軟件;
  • 僅將虛擬貨幣用於交換商品、服務或者出於投資目的的商家和消費者。[5]

2014年7月17日，相關部門公布了一項擬議的「BitLicense」的詳細信息，「BitLicense」對任何使用加密貨幣的居住在紐約的公司或個人進行了規定。[6][7] 擬議規定於7月23日在<<紐約州立法機構>>正式公布並開始了45天的評論期。[8][6] 2015年2月25日，修訂建議通告刊發，另有三十日評論期。[9]

條例於2015年8月8日生效。至少有10家比特幣公司因為新規定宣布停止在紐約州的所有業務。[10][11][12] 紐約商業雜誌稱這是「偉大比特幣的出埃及記」。[11] 2015年9月，位于波士頓的Circle獲得了第一個BitLicense許可證，儘管在2016年12月，該公司已經擺脫了比特幣交易所，更多地關注支付問題。[13][14][15][16][17]
