法律经济学

法律经济学（law and economics）或称法律的经济分析（economic analysis of law），是由美国学者在1960年代发展出的跨领域交叉学科。主要是以经济学的效率观点，分析法律的形成、架构、与运作方式，法律与司法制度对社会的经济效益影响。1960年，芝加哥大学教授罗纳德·科斯发表了“社会成本问题”(The Problem of Social Cost)，此论文提出后人所称的科斯定理，被视为是法律经济学的奠基之作。

法律经济学在汉语法学界

法律经济学在台湾

台湾在法律经济学的领域方兴未艾，此一领域比较知名的学者，如熊秉元著有《法律经济学开讲》和《正义的效益：一场法学与经济学的思辨之旅》、王文宇著有《民商法理论与经济分析》系列著作、简资修著有《经济推理与法律》，以及谢哲胜著有《法律经济学》，为较知名之著作。

法律经济学在中国大陆

法律经济学从1980年代中期开始在大陆出现，至今方兴未艾。这个领域比较知名的学者有北京大学法学院教授朱苏力、武汉大学教授漆多俊、浙江大学教授钱弘道、中国海洋大学教授桑本谦、中山大学教授周林彬、山东大学教授魏建、厦门大学教授龙小宁等。大陆经济学界也不乏有法律经济学的研究者，比较知名的包括浙江大学教授史晋川、山东大学教授乔岳等。

法律经济学在香港

许多香港的法律和经济学研究与新制度经济学有关。这些文章中有很多是由新制度经济学家撰写的。例如Li(2012)提出从过去20年的香港法律报告的资料显示, 自从第一起案件以来，渗水法庭案件的数量从1994年起增加了40倍 。赔偿总额也大大增加。但是，居民向法庭寻求赔偿的案件比噪音污染少得多。这可能反映了高昂的交易成本 。
